Terms of Service

By accessing and using this application ("InsureAIQ"), the user ("User") agrees to comply with all applicable laws and regulations of the Republic of South Africa, including but not limited to the Protection of Personal Information Act ("POPIA"), the Financial Advisory and Intermediary Services Act ("FAIS"), and any other relevant regulatory frameworks governing insurance and financial services.

1. Platform Purpose

InsureAIQ is an AI-assisted compliance and decision-support platform designed to support financial services professionals in performing administrative, compliance, advisory support and operational functions more efficiently. The Platform assists Users by analysing information, identifying potential compliance considerations, generating recommendations, supporting documentation, and improving workflow efficiency. InsureAIQ is designed to assist professionals to make better-informed decisions. It does not replace professional judgement, regulatory responsibility, or the professional obligations of financial advisers, compliance officers, or other authorised Users. All decisions, recommendations, and actions taken remain the sole responsibility of the User.

2. Permitted Use

The Platform is intended solely for lawful administrative, compliance, and operational functions within the insurance and financial services environment. The User agrees to use the Platform only for its intended purpose and in accordance with all applicable legal and regulatory requirements.

3. User Responsibilities and Conduct

The User undertakes to:

  • Provide accurate, complete, and up-to-date information at all times.
  • Maintain the confidentiality and security of login credentials and restrict access to authorised personnel only.
  • Ensure that any data uploaded, processed, or shared via the Platform is lawfully obtained and processed in compliance with POPIA.
  • Exercise due care and professional judgment when relying on outputs generated by the Platform, including AI-driven recommendations.

4. Prohibited Use

The User shall not:

  • Use the Platform to process, store, or transmit unlawful, fraudulent, or misleading information.
  • Grant access to unauthorised third parties or allow the Platform to be used outside of the User's authorised business scope.
  • Reverse engineer, copy, modify, distribute, or exploit any part of the Platform without prior written consent.
  • Use the Platform in any manner that may compromise the security, integrity, or functionality of the system.
  • Rely solely on automated outputs without appropriate human oversight, particularly in regulated advisory or underwriting decisions.
  • Use the Platform to generate false, misleading, fraudulent, or fabricated compliance records, client documentation, or regulatory information.

5. Third-Party Data and Misuse Protection

Where the User processes personal or third-party data:

  • The User warrants that they have obtained all necessary consents and legal grounds to process such data.
  • The User assumes full responsibility for the accuracy, legality, and integrity of third-party information submitted to the Platform.
  • The Platform provider shall not be held liable for any misuse, unauthorised disclosure, or unlawful processing of third-party data by the User.

6. Checks and Balances

The Platform may include automated checks, validations, and compliance prompts; however:

  • These do not replace regulatory obligations or professional duties.
  • The User remains fully accountable for verifying outputs, ensuring compliance, and making final decisions.
  • The User agrees to implement internal review processes where necessary to validate outputs generated by the Platform.
  • The Platform is intended to support, not replace, the User’s professional expertise, ethical obligations, and regulatory responsibilities.

7. Limitation of Liability

The Platform is provided as a support tool for administrative efficiency. While reasonable care is taken to ensure accuracy:

  • The Platform provider makes no warranties regarding completeness or suitability for specific decisions.
  • The User agrees that all use of the Platform is at their own risk.
  • The Platform provider shall not be liable for any direct, indirect, or consequential loss arising from misuse, reliance on outputs, or failure to comply with applicable laws.

8. Indemnity

The User agrees to indemnify and hold harmless the Platform provider, its directors, employees, and partners from any claims, damages, or losses arising from:

  • Breach of these terms,
  • Misuse of the Platform,
  • Unlawful processing of personal or third-party data, or
  • Non-compliance with applicable regulatory requirements.

9. Suspension and Termination

The Platform provider reserves the right to suspend or terminate access without notice where there is:

  • Suspected misuse,
  • Breach of these terms, or
  • Any activity that may expose the Platform provider to legal or regulatory risk.

By continuing to use the Platform, the User acknowledges that they have read, understood, and agree to these Terms.
